An interesting job opening appears exactly when you are on sick leave. Are you allowed to send in an application? Is an online interview possible? And does the potential new employer need to know that you are currently on sick leave? Such questions are delicate because two legitimate interests collide: your professional future and the duty not to jeopardize your recovery.

The short answer is: Applying while on sick leave is not generally prohibited in Austria. However, the individual case is always the deciding factor. An activity that is compatible with the illness, medical instructions, or the recovery process can be justifiable. A personal interview, a long journey, or even a trial shift, on the other hand, can create unnecessary labor law risks. Sick leave means incapacity for work, not automatically house arrest

Sick leave means that someone is temporarily unable to perform the work contractually owed due to illness or accident. Whether incapacity for work exists is determined by the attending physician. This is also confirmed by the Austrian Health Insurance Fund (ÖGK) regarding sick leave.

Incapacity for work is not to be equated with total inactivity for every illness. Someone who cannot perform a physically demanding shift due to an injury might still be able to draft an email for a short time. With an acute flu, however, even a seemingly harmless appointment can be unreasonable. For mental illnesses, exercise and a structured daily routine can be part of the treatment, while additional application stress could hinder recovery in another situation.

The Chamber of Labour (Arbeiterkammer) explains behavior during sick leave the central rule: Employees must not do anything that could delay their recovery. Even an online application from home does not automatically prove that your regular work would be possible again. The burdens can be completely different: Ten minutes on a private laptop are not the same as an eight-hour shift, customer appointments, heavy lifting, or constant concentration under time pressure.

Nevertheless, not every application activity is automatically harmless. Before sending, check:

  • Does the activity contradict a medical order or recommended rest?
  • Is the writing physically or mentally more strenuous than it initially seems?
  • Do you use exclusively private devices, accounts, and documents?

Are you allowed to go to a job interview while on sick leave?

There is no serious yes or no for a job interview without looking at the specific illness. The appointment must be compatible with recovery behavior. A one-hour interview including travel, waiting time, and return journey is a different burden than a short online interview. The external perception is also relevant: If the behavior obviously does not match the restrictions, the current employer can doubt the incapacity for work or suspect a breach of duty.

Four questions before accepting

  1. What is medically justifiable? If in doubt, clarify whether an interview, screen time, travel, or prolonged sitting would jeopardize recovery.
  2. How great is the burden? Consider preparation, clothing, travel, interview duration, and recovery time, not just the calendar entry.
  3. Does the behavior fit the clinical picture? An activity can be sensible for one diagnosis and clearly unsuitable for another.
  4. Is there a gentler alternative? A later appointment, a phone call, or an online interview can keep the process open.

Online is often easier, but not a free pass

The AMS describes online job interviews as a regular form of interview with its own preparation, technology, and professional framework. During sick leave, an online appointment can reduce travel and physical strain. It remains a demanding appointment nonetheless. Anyone who cannot muster the concentration, voice, or resilience should postpone instead of struggling through the interview.

How to postpone an appointment without medical details

A short-term illness can hit anyone. You do not automatically have to explain the diagnosis to a potential employer. A brief, reliable message is usually enough:

“Thank you very much for the invitation. Due to health reasons, I am unfortunately unable to attend the appointment on Tuesday with the necessary quality. Would Thursday morning or Friday from 2 PM be possible? Alternatively, I am happy to be available for a short online interview.”

Important are a quick notification, a concrete alternative proposal, and a professional tone. Anyone who cancels only a few minutes before the interview, even though the impediment was known for longer, creates avoidable doubts. Anyone who reacts early and in a solution-oriented manner, on the other hand, shows organizational skills.

These activities are particularly risky

There is a clear boundary between an application email and actual work performance. Employees should be particularly careful in the following situations:

  • Trial work or trial shift: This involves performing activities for another company. This can be incompatible with sick leave and trigger further legal questions.
  • Long journeys: A journey of several hours or a change of location can contradict medical requirements. A changed place of residence may also have to be reported to the health insurance provider.
  • Use of company equipment: Company laptop, professional email address, printer, or working time of the current employer do not belong in a private job search.
  • Confidential work samples: Customer data, internal key figures, source code, and unpublished projects must not be sent along.
  • Contradictory public posts: A photo alone proves little, but can trigger unnecessary conflicts if it obviously contradicts the reported restriction.

Does the current employer need to know about the application?

The job search is fundamentally a private matter. There is no general obligation to inform the current employer about an external application. Sick leave does not change this. However, discretion does not happen by itself. Use private contact details, deactivate conspicuous profile notifications, and explicitly state that the current employer must not be contacted without consent. Does the new employer need to know about the sick leave?

A temporary sick leave does not automatically have to be mentioned in an application. The deciding factor is whether you can fulfill the essential requirements of the targeted activity and when a realistic start of work is possible. A diagnosis belongs neither in the CV nor in the cover letter.

Instead of disclosing private health details, applicants can address concrete work ability:

  • “I can fulfill the tasks mentioned in the advertisement.”
  • “I am expected to be available for the intended start date.”
  • “I do not wish to provide information on private health data. We are welcome to discuss the essential requirements of the position individually.”

Incorrect statements about an objectively necessary professional requirement are not a good strategy. Do not plan the start date and termination too tightly

A new contract does not automatically resolve the health condition. Anyone promising a start date should realistically assess whether recovery, notice period, remaining vacation, and handover fit together. A change scheduled too tightly can lead to the new job starting with time pressure or another illness.

Do not quit your current job based solely on a verbal offer. First, check the activity, place of work, weekly hours, salary, collective agreement, probationary period, and start date in writing. If the sick leave still exists, possible effects of your own resignation or mutual termination on continued payment of wages and sick pay should also be clarified in advance with the Chamber of Labour or ÖGK.

Important: The current employer can also terminate employment during sick leave. The Chamber of Labour points out that the usual notice periods and dates apply and that very short deadlines may apply for a possible challenge. Anyone receiving a termination should therefore seek advice immediately and not wait for the outcome of the application.
