Leave approved, employer calls back: When employees are allowed to decline

Approved leave is binding. When an employer may nevertheless revoke it, which costs are reimbursed, and how employees should respond.

Blonde adult employee receives a callback from her employer during a summer break in Austria

The trip is booked, the vacation approved — and suddenly the employer demands that you work after all or return earlier. Such a call quickly creates pressure. Legally, however, the situation is clearer than some formulations like "We need you urgently" suggest: an effectively agreed vacation period is generally binding for both sides.

Only particularly serious, unforeseeable operational reasons can justify a unilateral withdrawal by the employer. The standard is even stricter if the vacation has already begun. This guide shows when an employer can revoke approved leave can, which costs must be reimbursed, how to assess availability, and how employees in Austria should respond matter-of-factly.

The short answer in five points

  • Leave is agreed between employer and employees; consent is generally binding.
  • Staff shortages, a sick colleague, or poor planning are usually not, by themselves, sufficient to justify a revocation.
  • Only a particularly serious, unforeseeable operational emergency can justify a unilateral withdrawal.
  • In the event of a justified revocation or a permissible recall, the employer must reimburse costs incurred and facilitate an alternative vacation date.
  • During vacation, there is generally no obligation to continuously check work phones, emails, or chats.

The specific individual case remains decisive. Anyone facing a binding instruction, a threat of termination, or high travel costs should secure documentation and quickly involve the Chamber of Labour, a trade union, or legal counsel specializing in labor law.

Why the vacation agreement is binding

According to § 4 of the Vacation Act, the timing and duration of the vacation must be agreed upon between the employer and the employee. In doing so, both operational requirements and the employees' opportunities for rest must be taken into account.

That means two things: Employees are generally not allowed to take leave on their own authority. Conversely, the employer may not cancel an already agreed date at will. Whether the agreement was made via a form, by e-mail, in an app or verbally does not automatically affect its validity. However, written evidence is far easier to prove.

The jobspot.at guide provides a detailed classification of entitlement, use and remaining leave Planning leave: What rules employees should know. The revocation concerns the next step: What applies if the date had already been agreed?

Four situations that should not be confused

1. The leave request is still pending

A mere request is not yet an agreement. If the employer has not yet agreed, employees should not book as if the date were fixed. An entry with the status "requested" in an app is also not necessarily an approval.

2. Leave has been approved but not yet taken

This concerns the withdrawal from a vacation agreement that has already been concluded. This is only conceivable unilaterally for particularly serious reasons. An employer can, of course, ask for a voluntary postponement. In that case, both sides should explicitly record that this is a new agreement.

3. The vacation has already begun

Recalling an employee from an ongoing vacation is generally not permitted according to the Corporate Service Portal on vacation law. It is only considered in exceptional cases of operational emergency. The hurdle for this is therefore particularly high.

4. The employer is only asking for information

Even a “short” phone call can be work. The question is then not necessarily a complete cancellation of vacation, but an interruption due to work performance. According to the Carinthian Chamber of Labour on availability during vacation official business phone calls or emails count as working time and must not be deducted from the vacation account.

What an operational emergency actually means

The term is often used too loosely in everyday life. A full order backlog, thin staffing or an awkward scheduling situation do not automatically constitute an operational emergency. According to case law, the presence of the specific person concerned must be absolutely necessary to avert substantial economic disadvantages for the company.

The Supreme Court in decision 9 ObA 98/22k confirms this strict standard: An employer can only unilaterally revoke a binding vacation agreement for particularly serious reasons. Furthermore, the employer must clearly communicate if they actually intend to withdraw from the agreement. Another personnel decision or a handover request does not automatically imply a revocation.

What is normally not sufficient

  • A colleague is suddenly absent due to illness.
  • The roster was understaffed.
  • A project is delayed, even though that had been apparent for some time.
  • The manager wants a familiar point of contact instead of the substitute.
  • More work came up than expected.
  • The person covering the leave did not receive full access or a proper handover.

Which is more like an exceptional case.

One conceivable scenario is a suddenly occurring, existential or at least seriously economically threatening situation that can only be averted by the specific person. Examples may include a major technical failure, an acute security situation, or the looming loss of a central operational area — but only if no reasonable substitute or other solution is available.

Even then, not every demand is automatically lawful. It must be examined whether the event was truly unforeseeable, why precisely this person is needed, which alternatives were attempted, and whether the extent of the return is proportionate.

Voluntary postponement or binding revocation?

This distinction is particularly important in practice. If a manager says 'Could you help us out?', that may be a request for a consensual change. 'Your vacation is hereby revoked', by contrast, asserts a unilateral legal position.

Ask in writing:

  • Is this a voluntary request or a formal revocation?
  • What specific unforeseeable operational emergency exists?
  • Why is my personal presence indispensable?
  • Which substitutes or technical alternatives were considered?
  • For what period am I expected to work or return?
  • Which travel, cancellation and rebooking costs does the company cover?
  • When will unused vacation time be made up?

Anyone who agrees voluntarily should still document all terms. A seemingly collegial agreement can later lead to disputes over vacation days, working hours, or costs.

Which costs the employer must reimburse

The USP states: In the case of a justified cancellation due to an unforeseeable change in operational circumstances, the employer must offer an alternative vacation date and compensate for any losses incurred. This can include, in particular, cancellation or rebooking fees for an already paid travel arrangement.

Typical cost items

  • Cancellation fees for accommodation, package tours, car rental, or booked activities
  • Rebooking fees for train, flight, or ferry
  • additional return travel costs after a recall
  • non-refundable reservations, to the extent they are directly affected
  • possible additional costs for accompanying relatives, where they are causally related and can be substantiated

Not every claimed amount is automatically reimbursable. Employees should keep receipts, check reasonable cancellation or rebooking options, and submit a cost breakdown. For larger amounts or disputes about accompanying persons, individual legal advice is advisable.

Clarify in writing before rebooking

If time allows, send a short statement of the currently expected costs and request written confirmation of cost coverage. If the recall occurs at very short notice, at least secure booking confirmations, fare conditions, screenshots and payment receipts. Do not rely solely on a telephone promise.

What happens to vacation days and working time

Leave is intended for rest. Periods in which employees actually work on instruction cannot therefore be treated at the same time as taken leave. Have the affected hours or days corrected in the working-time and leave records.

Phone call, email, or remote access

Even specific work-related tasks can count as working time. Note the date, start time, end time, and activity. A two-minute phone call and three hours of remote access are practically different, but neither should simply remain invisible.

Return journey by order

If a person is required to return by instruction of the employer, additional questions regarding travel time and costs arise. The Labor Inspectorate on travel times explains that travel time is generally working time; different limits and rest requirements apply to active and passive travel times. The specific remuneration under the collective agreement may need to be examined separately.

Reschedule replacement leave

The unused portion does not disappear. Agree on a new date and have corrected vacation days confirmed in the system. A vague statement like "We'll make up for that sometime" is unnecessarily risky.

Do employees have to be reachable while on vacation?

In principle, no. Vacation is not on-call duty. A company mobile phone does not obligate employees to constantly check calls, e-mails, or chat messages. The Arbeiterkammer Kärnten emphasizes that the employer may not order on-call duty or work during vacation and should establish cover arrangements.

An agreed on-call duty is incompatible with the restorative purpose of a simultaneously booked vacation. Someone who voluntarily reads messages does not automatically create a permanent obligation to be reachable. For clear boundaries, an out-of-office notice, a substitute, a handover, and turning off work-related notifications help.

jobspot.at-guide Take over vacation coverIt shows how tasks, decision-making boundaries and escalations can be sensibly arranged before an absence. Good preparation reduces follow-up questions, but does not change the right to rest.

How to respond to a callback: seven steps

  1. Secure the vacation agreement:Save approval, app status, email or chat history.
  2. Clarify the form of the request:Ask whether it is a request or a claimed revocation.
  3. Require justification:Have operational emergency, unforeseeability, and personal necessity specified.
  4. Do not cancel anything prematurely:Check costs and rebooking conditions before changing bookings.
  5. Record conditions in writing: Kostenübernahme, Rückreise, Arbeitszeit, Urlaubskorrektur und Ersatztermin gehören in die Bestätigung.
  6. Arbeitsleistung dokumentieren:Record phone calls, emails, remote accesses, travel and duty times.
  7. Seek advice:In cases of pressure, threats of dismissal, unclear instructions, or high costs, the Chamber of Labour, the union, or legal counsel should review the situation.

A neutral response template

My vacation was agreed for the period from … to … and is already booked. Please inform me in writing whether you are requesting a voluntary postponement or are revoking the vacation agreement due to a concrete operational emergency. Please also explain why my personal presence is indispensable, which alternatives were considered, and how cancellation, rebooking or return travel costs, working time, vacation days and a replacement date will be handled. Upon receipt of this information I can consider the next steps.

The template is intentionally neutral. It does not refuse outright, but provides a reliable basis. Adapt it to the situation, availability and urgency.

Three practical examples

Case 1: Two colleagues are sick at the same time

A restaurant created the summer staffing schedule with little slack. After two sickness reports, a waitstaff member whose leave has already been approved is being asked to cancel their trip. Staff shortage alone is not automatically a sufficient reason to revoke leave. The employer must show why the situation is exceptional, which replacement options were considered, and why this particular person is indispensably needed.

Case 2: Critical system failure in operations

A central system fails unexpectedly and poses a significant threat to operations. Only one specialist on leave has the necessary authorization and up-to-date knowledge; external help is not available in time. This may constitute an especially serious exceptional case. Nevertheless, the extent, alternatives, costs, and compensatory leave must be clarified.

Case 3: Recall from abroad

An employee has already traveled with their family and is expected to return within a day. Assuming a permissible operational emergency, the employer must reimburse the costs caused by the recall. Bookings, rebooking offers, and return travel receipts should be secured immediately. The handling of travel time and unused vacation days should also be recorded in writing.

What employees should avoid

  • Assuming that vacation is final without confirmed approval
  • Immediately cancel (incurring charges) in response to an unclear request
  • Only negotiate high costs or vacation days by phone
  • Performing work during vacation without time tracking
  • Ignoring an instruction even though its legality is unclear and a quick consultation is possible
  • Confirming a 'voluntary' postponement under pressure without clarifying the conditions

A case of the Styrian Chamber of Labour shows how important evidence can be: in that case the previously concluded vacation agreement could be proven in a later dispute. The case ended with a court settlement in favor of the affected apprentice.

FAQ on revoking vacation

Can the employer cancel approved vacation due to staff shortages?

Not readily. Case law requires particularly serious reasons and the unavoidable necessity of precisely that person. Routine staff shortages or organizational shortcomings generally do not suffice.

Is a verbal vacation approval valid?

A vacation agreement is not necessarily bound to a specific form. The practical problem is proof. Therefore, briefly confirm verbal arrangements by e-mail or in the company's vacation system.

Do I have to provide my vacation address or private phone number?

There is no general obligation to be reachable while on vacation. Specific duties or expressly agreed arrangements may require individual assessment, but they must not simply undermine the restorative purpose of the vacation.

What if I voluntarily reschedule?

Then both parties enter into a new agreement. Still, clarify in writing the costs, the new date, the validity of days already taken, and any additional working time. Voluntariness does not mean that financial consequences should be left unresolved.

May I work while on vacation instead of returning?

Only if both parties agree on a suitable working arrangement and issues under labor, data protection, tax and social security law are clarified. Vacation does not automatically become a Workation as a result. For this, the jobspot.at-guide Plan a workation your own overview.

Who reviews a disputed individual case?

The Chamber of Labour, a union, or an employment-law representative can assess documents and urgency. In the case of dismissal or termination, short deadlines for contesting or asserting claims may apply; therefore seek advice promptly.

Conclusion: Approved leave is not just an informal request

An employer in Austria cannot simply revoke approved leave because of every operational difficulty. An exceptionally serious, unforeseeable reason is required—one in which the affected person in particular must avert substantial economic harm. A particularly strict standard applies to recalling someone from leave that has already begun.

Don't react hastily or confrontationally. Secure the agreement, clarify in writing whether this is a request or a formal revocation, document costs and working time, and have contested directives reviewed promptly. This way you protect rest, vacation days, and financial claims without ignoring a genuinely serious operational situation.
